CCPC Names 18 Traders Nationwide in Consumer Law Enforcement Action

The Competition and Consumer Protection Commission (CCPC) has published details of enforcement action against traders in Donegal, Dublin, Galway, Kerry, Waterford, Wicklow and online, for breaches of consumer protection law.

In total, 31 fixed payment notices and compliance notices were issued to 18 traders across the country, following inspections and investigations carried out by CCPC officers in store and online. The breaches include failure to comply with price display laws and giving consumers misleading information about their rights.

On price display, Cedarglade Ltd, trading as Centra in Greystones, Co. Wicklow, was issued three fixed payment notices, and Seafront Gold, trading as Spar in Bray, Co. Wicklow, was issued two. Wescooley Ltd, trading as Oasis Bar in Letterkenny, Co. Donegal, was issued two compliance notices. Single fixed payment notices went to Dee-Al Retail Ltd, trading as Spar in Dublin 8; Glenella Foods Ltd, trading as Eurospar in Ballymun, Dublin 9; Lucy McEvilly, trading as Connemara Horse and Country in Clifden, Co. Galway; Pixie and Linus Ltd, trading as The Hen & Hog in Ashford, Co. Wicklow; and Skerries Hardware Limited, trading as Skerries Hardware and Pet Centre in Skerries, Co. Dublin.

On unit pricing, which allows consumers to compare the cost of similar products sold in different sizes, three fixed payment notices each went to Ballymaley Stores Ltd, trading as Homesavers in Ballyshannon, Co. Donegal; Corajio Unlimited Company, trading as Mr Price in Kingsmeadow, Co. Waterford; and Rafterstreet Stores Ltd, trading as Homesavers in Letterkenny, Co. Donegal. Single fixed payment notices went to Owen & Ciaran Durkin, trading as Costcutter in Baile na hAbhann, Co. Galway, and P&T Fitzgerald (Hardware) Ltd, trading as Fitzgerald Homevalue Hardware in Dingle, Co. Kerry.

On misleading consumers about their rights, from the 14-day cooling-off period for online purchases to redress for faulty goods, Pure Fashions Ltd, trading as pureonline.ie with an address in Letterkenny, Co. Donegal, was issued three compliance notices. Crean Solutions Ltd, trading as MicksGarage.com with an address in Dublin 10, was issued two. Single compliance notices went to Party HQ Ltd, trading as Christmas HQ in Stephens Green, Dublin 2, and Woodside Furniture Ltd, trading as Pieces in Malahide, Co. Dublin.

Separately, Tongali Trading Ltd, trading as Ciaran O'Flynn Jewellers in Dungarvan, Co. Waterford, was issued one compliance notice for failing to display a required precious metals information notice to consumers.

"Consumer protection law supports consumers to make informed choices when shopping. Whether online or in store, traders must not mislead consumers about their rights. Consumers must be able to compare prices, get redress for faulty goods, and use the 14-day cooling-off period for online purchases across the EU.

A fixed payment notice is a set fine of €300 issued for failing to correctly display prices or provide certain required information to consumers. A compliance notice is a written legal notice directing a trader to stop a prohibited practice and comply with the law by a set date; failure to do so is an offence and can lead to prosecution.
